You probably have experience in the system
and may even be working in it right now. In what part of the criminal justice
system do you work? If you are not working in the system, what part of it would
you like to work in, and why? Do you think learning about the rest of the
system will make your job easier, and if so, how?

Both criminal law and civil law attempt to
control people’s behavior. How does each type of law attempt to accomplish
this? What major significant differences exist between the two? Which, in your
opinion, is more effective?

Theories to explain crime include those that
consider biological, psychological, and sociological theories, among others.
One set of theories that uses the scientific method modeled after the natural
sciences is positivism. What are some positivistic theories of crime, and how
well do they explain criminal behavior?

What happens when different parts of the
criminal justice system vie for the same case, same person, same resources, and
so forth, and why does this occur? What suggestion do you have for reconciling
situations like these that will likely occur again?

In law enforcement, the use of discretion is
an important part of the system. To start this discussion, let’s first address
the question of what discretion is, including the strengths and weaknesses of
the use of discretion by police officers. Next, mention an abuse of discretion.
Finally, comment on another student’s example of an abuse with a suggestion of
how a police department could address the abuse.
CRMJ 300 WEEK 4 A SUPREME COURT DIALOGUE
In advance of participating in this discussion, review
the Supreme Court tutorial found at the bottom of the Week 4: Lesson page. On
January 24, 2002, the Olympic torch relay was to run in front of a high school
in Juneau, Alaska. School was dismissed early that day so that students could
watch the relay pass in front of the school. One student, whose last name is
Frederick, arrived late that day just in time to watch the Olympic torch pass
in front of the school. He brought with him a very large banner that he
displayed as the torch passed in front of the school. The banner read “BONG
HITS 4 JESUS.” (Frederick claimed that he saw this on a sticker once and
thought it was funny.) Frederick was immediately suspended from school by the
principal, Mrs. Morse, for violating the school’s drug policy. Frederick then
filed a lawsuit claiming that his freedom of speech was violated. This case has
now been appealed all the way to the Supreme Court, and the court needs to
decide if the school’s rights or the rights of the student should be protected
by the law.
You are now the judge! Listen to actual oral arguments before the Supreme Court, and ask questions along with the Justices. The assignment, after you watch the case proceedings, is to write a decision in the case that is at least a paragraph in length. What are the arguments in the case — should Frederick have been suspended? When does a school have the right to limit freedom of speech? Explain your reasoning. Then be sure to provide a substantive comment on the reasoning that a classmate uses to arrive at a decision.

CRMJ 300 WEEK 4 ROLE OF THE DEFENSE
Perhaps every attorney who works as criminal
defense counsel has heard this question: “I don’t know how an attorney can
represent a pedophile” (or rapist, terrorist, and so forth). What kind of answer
could you come up with? What principle or principle(s) would you cite to in
support of your answer? Do you accept or reject a classmates’ response; why or
why not?

Think about the major phases of a death
penalty case and focus on the latter stages. How could a jurisdiction satisfy
the requirements of a fair legal trial and appeal of conviction of an offender
sentenced to execution and still speed up the process of executing these
people? Would it be worth it to a society to engage in the steps that you
suggest could be taken?
CRMJ 300 WEEK 5 PLEA BARGAINING
Only a small percentage of cases ever go to
trial. The vast majority (over 90%) are resolved by negotiation or “plea
bargaining.” Discuss the good and bad points about plea bargaining. Do you
agree or disagree with plea bargaining? Why or why not?

In general, more people receive dispositions
for community supervision than for incarceration. What are the different kinds
of community release? Are they effective? Why or why not? Identify at least one
controversy regarding their use and explain why this controversy exists?

The history of incarceration reveals
intervals where people have to “break rocks” or receive services that could
reduce the risk of recidivism upon completion of a sentence. Explain where you
think society is, currently, in terms of whether one or the other is the
prevailing approach in this country. Do you see that lasting for much longer
and heading in the other direction? Why?
CRMJ 300 WEEK 7 CHARGING CHILDREN AS ADULTS
Consider the following statement: there has
been a trend towards treating children as adults in the criminal justice
system. Would you agree or disagree with that statement? In what direction do
you foresee society heading on this issue? Why?
CRMJ 300 WEEK 7 JUVENILE JUSTICE SYSTEM
When it comes to resolving legal charges, do
the reasons for treating juveniles differently than adults remain valid? Why or
why not? Given the opportunity to add or remove those reasons, what would you
choose to do and why?
